General
R&D Design Lab will carry out work only where an agreement is provided either by email or mail.
R&D Design Lab will carry out work only for clients who are 18 years of age or above.
An order is deemed to be a written contract between R&D Design Lab and the client.
Quotes & Contracts
R&D Design Lab reserves the right to change or update these terms at any time without prior notice.
Charges & Fees
Projects will be split into 3 payments. Details will be specified in the individual proposal.
Travel expenses
For clients located more than 30 kilometers from R&D Design Lab’s registered office, the client agrees to pay all travel expenses incurred getting to and from a clients premises. This holds unless we specify differently.
Communication & Delivery
The majority of communication is conducted by email, as this allows us to document a complete virtual ‘paper trail’.
Copyright & Ownership
Upon completion of the project, R&D Design Lab transfers all rights and ownership of CUSTOM design produced by R&D Design Lab to the client.
Software and third party programs are not transferred to the client and remain under copyright of their respective owners.
Websites set up in our system are not transferrable to any third-party hosting service. Should you want a replica of your website setup elsewhere, you’ll need to contract a third party developer to ‘redevelop’ your website for you from scratch.
R&D Design Lab reserves the right to display websites and graphics that have been designed by R&D Design Lab on their website, and in any marketing material to aid as examples of our work.
Domain Names – assuming your domain name has been paid for, it remains your legal property and we will release to you a UDAI code to you should you wish to transfer it to a third party.
Development & Delivery
R&D Design Lab understands the importance of completing projects in a timely manner. We agree to complete the project within 60 days from the date of contract signing. This however is subject to the client suppling R&D Design Lab with complete text, graphic content and other requested materials for the contracted client within 14 days of contract signing.
Liability
Services purchased from R&D Design Lab are provided “as is” without warranty of any kind that the project will be uninterrupted or error free. In no event shall R&D Design Lab be liable to the client for any direct, indirect, special, punitive, incidental, or consequential damages arising out of the use of the website, services, and/or goods provided to the client. This includes, without limitation, lost profits, business interruption, loss of data or other losses directly resulting from the use of the website, services, and/or goods provided to the client. The entire risk as to the quality and performance of the project is with the client.
Payments
R&D Design Lab accepts payment via Direct Credit, Cheque or Credit Card via PayPal (3% surcharge).
Full payment is due within 7 days of an invoice being issued, unless it comes under scope of the aforementioned situation.
If accounts are not settled or R&D Design Lab have not been contacted regarding the delay, access to the related service may be denied, we will then pass such cases to our elected debt collection agency to pursue payment. Non payment can result in small claims court action and submission of debtor to Baycorp Advantage Credit Rating list.
The client is liable to pay any debt collection or legal fees that transpire in the course of seeking settlement of an overdue account.
Project Consideration
We will not accept projects that we find morally questionable, unethical, or distasteful.
Quotes & Contracts
Quotes provided to prospects will be honored for 30 days. A new quote will then be provided upon request.
